About Transpport and These Terms
Transpport is a technology-based logistics and delivery platform operated by Transpport Lynk Private Limited, a company incorporated in India with its registered office in Kolkata, West Bengal (Registered under MCA, Government of India) (CIN available on request). The Transpport mobile application (the “App”) connects customers who need transport or delivery services with independent riders and driver-partners.
These Terms of Service (“Terms”) govern your access to and use of the App and all related services. By using the App, you enter into a binding agreement with Transpport Lynk Private Limited.
Eligibility
You may use the App only if:
- You are at least 18 years of age
- You are capable of entering into a legally binding contract under applicable Indian law
- You are accessing the App for a lawful purpose
- Your account has not previously been suspended or terminated by Transpport
By using the App, you represent and warrant that all of the above conditions are met at the time of use.
Account Registration and OTP-Based Access
To use the App's booking features, you must register an account using your mobile phone number. Registration is completed through a One-Time Password (OTP) sent to the mobile number you provide. You are responsible for:
- Ensuring that the mobile number you register is accurate and belongs to you
- Keeping your account access secure and not sharing OTPs with any other person
- All activity that takes place under your account, whether or not you authorised it
If you believe your account has been compromised, you must notify us immediately at our support contact provided in Section 17.
Booking Flow and Service Description
Transpport provides a technology platform through which you can:
- Request transport or delivery services (“Bookings”) within available service areas
- View estimated pricing before confirming a Booking
- Track the status of your Booking through the App in real time
- Communicate with the assigned rider/driver-partner for delivery-related purposes
Pricing and Charges
The estimated price of each Booking will be displayed in the App before you confirm. Prices are calculated based on factors including distance, vehicle type, time of day, and demand conditions. Final charges may differ from estimates if the actual journey or delivery details change after confirmation.
Transpport may apply surge pricing or promotional discounts from time to time. Any applicable charges will be clearly shown in the App before you confirm the Booking. All prices are inclusive of applicable taxes unless stated otherwise.
Cancellations and Rescheduling
Cancellations and rescheduling are governed by Transpport's Cancellation, Refund and Reschedule Policy, which forms part of these Terms. Please refer to our Cancellation & Refund Policy page for full details. A cancellation fee may apply if you cancel after a rider has been assigned, as specified in that Policy.
Payment Authorisation
By confirming a Booking, you authorise Transpport (or its payment service provider partners) to charge the applicable amount to your selected payment method. Payments may be processed via UPI, debit card, credit card, or other payment methods available in the App through third-party payment gateway partners.
Transpport does not store your full card or bank details. Payment processing is handled by regulated third-party gateway partners. Transpport is not liable for payment failures caused by your bank, network conditions, or the payment gateway.
Refunds
Refunds, where applicable, will be processed in accordance with the Cancellation, Refund and Reschedule Policy. Refunds will be credited to the original payment source, subject to your bank's or payment provider's processing timelines. Customer Responsibilities
When using the App, you agree to:
- Provide accurate pickup and drop-off location details
- Be available at the pickup location within a reasonable time of the rider's arrival
- Ensure that any items sent for delivery comply with applicable laws and Transpport's prohibited items list
- Treat rider/driver-partners with respect and courtesy at all times
- Not attempt to contact or transact with riders outside the App for services similar to those offered on the platform
Prohibited Use
You must not use the App to:
- Book transport for illegal goods, hazardous materials, weapons, drugs, or any items prohibited by applicable Indian law
- Provide false information, create fake accounts, or impersonate another person
- Interfere with the App's technical systems or attempt to reverse-engineer the platform
- Manipulate ratings, reviews, or incentives in a fraudulent manner
- Use the platform for personal commercial gain in a way that competes with or undermines Transpport's business model
Violation of any of the above may result in immediate suspension or termination of your account and, where applicable, referral to law enforcement authorities.
Service Availability
Transpport currently operates across India, with service availability expanding on an ongoing basis. Coverage may vary by city, time of day, weather conditions, and rider availability. Transpport does not guarantee that services will be available at all times or in all locations.
We may suspend or modify the App or any feature without prior notice for maintenance, upgrades, or any other operational or legal reason.
Third-Party Service Providers
Rider/driver-partners on the Transpport platform are independent contractors and not employees or agents of Transpport. Transpport does not control the manner in which riders perform their services. Any disputes arising directly between you and a rider/driver-partner shall be resolved between the parties, though Transpport may provide reasonable assistance in appropriate cases.
The App may integrate with or link to third-party services, including payment gateways and map providers. Transpport is not responsible for the content, availability, or privacy practices of such third-party services.
Limitation of Liability
To the maximum extent permitted by applicable Indian law, Transpport shall not be liable for:
- Loss or damage to goods during delivery
- Delays caused by traffic, weather, or rider unavailability
- Indirect, incidental, or consequential losses arising from your use of the App
- Payment failures caused by third-party gateways
- Any actions or omissions of independent rider/driver-partners
Transpport's total liability for any claim arising under these Terms shall not exceed the amount paid by you for the specific Booking to which the claim relates.
Suspension and Termination of Access
Transpport reserves the right to suspend or permanently terminate your account if:
- You breach any provision of these Terms
- We have reasonable grounds to believe your account is being used fraudulently or for illegal activity
- You repeatedly engage in abusive behaviour towards rider/driver-partners or Transpport staff
- Your account has been inactive for an extended period
You may delete your account at any time from within the App settings.
Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall first be attempted to be resolved amicably between the parties. If unresolved within 30 days, disputes shall be referred to the courts of Kolkata, West Bengal, which shall have exclusive jurisdiction over the matter.
Changes to These Terms
Transpport may update these Terms from time to time to reflect changes in our services, business practices, or applicable law. We will notify you of material changes through the App or via your registered mobile number. The date at the top of this page will be updated accordingly.
Continued use of the App after the effective date of any update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
